This document outlines the conditions that regulate the use of this website and the contract that binds both parties. These Conditions establish the rights and obligations of users and Por Soleá regarding the products and services we offer through this website (porsolea.com). By using this website or placing an order through it, you consent to be bound by these Terms of Service, the Shipping Policy, and our Privacy Policy. If you do not agree with all of them, you should not place any orders.

These Conditions may change, so you should review them before placing each order.

By placing an order through this website, you guarantee that you are over 18 years of age and that you have the legal capacity to enter into this Contract.

These Conditions are the only conditions applicable to the use of this website and replace any others, except for prior express written consent by Por Soleá. These Conditions are important for both you and us as they have been designed to create a legally binding agreement between us, protecting your rights as a customer and our rights as a company.

Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy and security of the information transmitted or obtained through this website unless expressly stated otherwise.

You declare that, by placing your order, you have read and accepted these Conditions.

 

Product Availability

 

All product orders are subject to availability, and in this sense, if there are difficulties in their supply, or if items are out of stock, we reserve the right to provide you with information about substitute products of equal or higher quality that you can order. If you do not wish to order those substitute products, we will refund any amount you may have paid.

The products we sell, especially artisan products, often have characteristics of the natural materials used in their manufacture. These characteristics, such as variation in grain, texture, knots, and color, will not be considered defects. On the contrary, they should be expected and appreciated. We only select products of the highest quality, but natural characteristics are unavoidable and should be accepted as part of the individual appearance of the product.

 

Price and Payment

 

The prices on the website include VAT but exclude shipping costs, which will be added to the total amount due.

The price of each product will be the one stipulated on our website at any given time, except in the case of manifest error.

 

Price Errors

 

Although we try to ensure that all prices on the website are correct, errors may occur. If we discover an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, the order will be considered canceled, and any amounts paid will be refunded in full.

We will not be obliged to supply you with the product(s) at the incorrect lower price (even if we have sent you the Shipping Confirmation) if the error in the price is obvious and unmistakable and could have reasonably been recognized by you as an incorrect price.

 

Payment Process

 

Once you have made your purchases, all items you wish to purchase will have been added to your basket, and the next step will be to process the order and make payment. To do this:

1. Click on the “Basket” button at the top of the page.
2. Click on the “Checkout” button.
3. Fill in or check the contact information, your order details, the address to which you want the order to be sent, and the address to which the invoice should be sent.
4. Enter your credit card details.
5. Complete the transaction.

 

VAT

 

By default, we present prices with Value Added Tax (VAT) included.

Any purchase within the EU VAT zone is subject to VAT unless it is a business outside of Spain with a validated VAT number (NIF) for intra-community transactions.

For deliveries outside the European Union and its VAT zone, VAT is excluded, and the taxes upon arrival of the package are the responsibility of the customer.

 

Contract Formation

 

This information and the details contained on this website do not constitute a sales offer but an invitation to do business. There will be no contract between us regarding any product until your order has been expressly accepted by us (even if you have already been charged). If your offer is not accepted, and you have already been charged, the amount will be fully refunded.

To place an order, you must follow the online purchase procedure and “authorize payment.” After this, you will receive an email acknowledging receipt of your order (the “Order Confirmation”). Please note that this does not mean your order has been accepted, as it constitutes an offer you make to purchase one or more products.

All orders are subject to our acceptance, and we will confirm such acceptance by sending you an email confirming that the product is being shipped (the “Shipping Confirmation”). The contract for the purchase of a product between us (the “Contract”) will be formed only when we send you the Shipping Confirmation. Only those products listed in the Shipping Confirmation will be subject to the Contract. We will not be obliged to supply any other products that may have been subject to an order until we confirm the shipment of such products in a separate Shipping Confirmation.
